These User Agreement and Terms of Use (“Terms”) govern your use of the Sojourundo mobile application and related services provided by MilForge Labs LLC (“MilForge Labs,” “we,” “us,” or “our”).
For the iOS application distributed through Apple's App Store, Apple's Standard End User License Agreement governs the application license. These Terms address Sojourundo's account and service-specific rules and do not replace Apple's Standard End User License Agreement. The standard license is available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.
Before creating your fitness profile, Sojourundo will ask you to review and explicitly accept these Terms and separately acknowledge that you have reviewed the Privacy Policy. Selecting the Terms acceptance control records your agreement to these Terms. Signing in alone does not record that acceptance.
Accepting these Terms or acknowledging the Privacy Policy does not grant permission to share information with OpenAI or enable optional AI personalization. Sojourundo requests separate core AI permission before your first AI-powered action. Optional AI sharing remains off unless you separately enable and confirm a category in Profile → Connections after saving your profile.
1. Eligibility
You must be at least 18 years old to create an account or use Sojourundo.
By creating an account, you represent that you are at least 18 years old and are legally capable of agreeing to these Terms. You must provide accurate age information.
Sojourundo uses a self-reported birthdate check to determine age eligibility. The birthdate is processed temporarily and is not retained as part of your account or sent to AI. We retain an eligibility record as described in the Privacy Policy. Entries indicating an age under 18 cannot continue through signup or access age-restricted account features. Existing accounts must complete screening before accessing those features. This check is not identity verification and does not guarantee that a person has supplied a truthful birthdate. App Store age ratings are an additional safeguard, not a replacement for this eligibility requirement.
Sojourundo's initial release is intended for use in the United States.
2. Fitness Guidance, Not Medical Care
Sojourundo provides general fitness information, including AI-generated workouts and equipment recognition. It does not provide medical advice, diagnosis, treatment, rehabilitation, or medical clearance to exercise. Providing profile information or receiving a tailored workout does not establish that an exercise is safe or appropriate for you.
We recommend that you consult your doctor or another qualified healthcare professional before beginning a new exercise program using Sojourundo, particularly if you have an injury, medical condition, symptoms, or concerns about exercising safely. Follow any medical restrictions or guidance you have received.
3. Exercise Risks and Your Responsibility
Exercise can cause injury, including strains, falls, aggravation of existing conditions, and serious injury. You choose whether to begin, modify, substitute, or stop an exercise. A prescribed movement, repetition count, duration, or weight is a suggestion, not a requirement to perform activity that is unsafe or unsuitable for you.
Review your workout and equipment list before starting. Use equipment in safe condition, allow sufficient space and support, and choose movements and loads you can control safely. Seek qualified instruction for unfamiliar exercises. Consult an appropriate healthcare professional if you have an injury, medical condition, symptoms, or concerns about exercising safely, and follow medical restrictions you have received.
Stop if continuing feels unsafe or you experience concerning symptoms, and seek appropriate medical attention. In an emergency, contact emergency services.
4. Starting a Workout
Before selecting Start Workout, review the plan, your surroundings, available equipment, and your own condition. Sojourundo does not supervise exercise, inspect equipment or surroundings, monitor your physical condition, or provide emergency assistance. Starting a workout does not constitute medical clearance.
Acknowledging exercise risks or starting a workout does not, by itself, release MilForge Labs from liability for negligence or waive rights protected by applicable law.
5. Artificial Intelligence
AI-generated workouts and equipment recognition can be inaccurate, incomplete, or unsuitable. Review recommendations before using them and correct equipment-recognition errors. AI output does not replace your judgment or qualified professional advice.
Sojourundo requests separate permission before sending information to OpenAI, as explained in the Privacy Policy and AI disclosure. You can withdraw that permission in Profile → Connections. AI-dependent features will then be unavailable until permission is restored; your account and saved information are not automatically deleted.
6. Your Account
You are responsible for maintaining the security of your account credentials and for activity occurring through your account.
You agree to provide information that is reasonably accurate when information is necessary for Sojourundo to provide personalized functionality.
You may update applicable profile information and preferences through the application.
7. Account Deletion
You may permanently delete your account through Sojourundo.
Sojourundo provides a final confirmation before deletion. Once you confirm permanent account deletion, there is no recovery or undo period.
Deletion removes the account and associated information from active Sojourundo systems as described in the Privacy Policy. Information may remain temporarily in managed backups or provider security, operational, or legal records according to applicable retention practices.
8. Acceptable Use
You may not misuse Sojourundo or attempt to:
- Gain unauthorized access to accounts, systems, APIs, or services;
- Interfere with the operation or security of the service;
- Circumvent security, usage, or access controls;
- Use Sojourundo for unlawful purposes;
- Introduce malicious code or intentionally harmful content; or
- Use the service in a manner that violates applicable law or the rights of others.
9. Equipment Photos and User-Provided Content
You are responsible for photographs and other content you choose to submit.
When submitting equipment photographs for recognition, avoid including people or unnecessary personal, confidential, or sensitive information.
You represent that you have the right to submit content you provide through Sojourundo for the purposes for which you submit it.
10. Availability and Changes to the Service
Sojourundo may evolve over time. Features may be added, changed, limited, or discontinued.
We do not guarantee that every feature will always be available or that AI-generated output will always be available, uninterrupted, or error-free.
11. Privacy
Your use of Sojourundo is also subject to the Sojourundo Privacy Policy, which explains how personal information is collected, used, shared, retained, and deleted.
12. Changes to These Terms
MilForge Labs may update these Terms from time to time to reflect changes to Sojourundo, our practices, applicable requirements, or other legitimate reasons.
When changes are material, we will provide an in-app notice and, where relevant, an account email. Sojourundo will present a review prompt requiring you to accept the updated Terms before continuing to use affected features. The acceptance record will identify the Terms version and the server-recorded acceptance date. These service-related notices are separate from marketing communications.
Updates to the Privacy Policy will be presented for separate acknowledgment as described in that policy. Acknowledgment does not itself grant new AI permission or enable optional AI sharing.
Changes requiring new privacy or AI consent will be handled through the applicable disclosure and consent process rather than relying solely on your prior acceptance of these Terms.
13. Disclaimers
Sojourundo and its content and features are provided on an “as is” and “as available” basis to the extent permitted by applicable law.
MilForge Labs does not warrant that AI-generated workouts, equipment recognition, or other content will always be accurate, complete, appropriate, or error-free.
To the extent permitted by applicable law, MilForge Labs disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement in relation to Sojourundo's services. We do not guarantee a particular fitness result, weight change, performance improvement, or that a workout will be suitable for every user or every circumstance.
We do not guarantee that the services will be uninterrupted, error-free, or free from every security threat, or that every defect will be corrected. These disclaimers do not reduce our obligations under applicable law or permit us to disregard our stated privacy practices.
Some laws do not allow certain warranties to be excluded. These disclaimers apply only to the extent allowed by the law applicable to your claim and do not exclude mandatory consumer rights. They address Sojourundo's services and do not replace or amend Apple's Standard End User License Agreement for the iOS application license.
14. Limitation of Liability
TO THE EXTENT PERMITTED BY APPLICABLE LAW, MILFORGE LABS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF OR INABILITY TO USE SOJOURUNDO'S SERVICES, INCLUDING LOST PROFITS, LOST BUSINESS OPPORTUNITIES, OR LOSS OF DATA, EXCEPT WHERE THE EXCEPTIONS BELOW APPLY.
The limitation above does not apply to claims for death or personal injury, fraud, gross negligence, willful misconduct, or any liability or remedy that applicable law does not permit us to exclude or limit. Nothing in these Terms releases MilForge Labs from liability for negligent conduct causing death or personal injury.
These Terms do not impose a monetary cap on direct damages or require you to indemnify MilForge Labs for all claims arising from your use of the app. These service-specific provisions do not replace or amend Apple's Standard End User License Agreement.
15. Governing Law and Dispute Terms
These Terms are governed by the laws of the State of Florida, except where applicable law requires otherwise. Nothing in these Terms excludes mandatory rights or protections available to you under applicable law.
These Terms do not require mandatory arbitration or include a class-action waiver. Disputes may be brought before a court with jurisdiction over the dispute, subject to applicable law.
16. Termination
You may stop using Sojourundo and delete your account at any time.
MilForge Labs may suspend or terminate access when reasonably necessary to protect the service or its users, address violations of these Terms, comply with legal requirements, or respond to misuse.
Where practical, we will provide notice explaining the reason for a restriction and any steps available to address it. We may act immediately without advance notice when reasonably necessary to respond to a serious security threat, misuse, fraud, unlawful activity, or a legal requirement. We may limit the details provided when disclosure would compromise security, an investigation, or compliance with law.
You may contact support@sojourundo.com to ask about a restriction or request that we review a decision. Providing a review channel does not guarantee reinstatement or a particular resolution date.
Suspending or terminating access does not, by itself, permanently delete your account or all stored information. You may request account deletion through the app where available, or contact privacy@sojourundo.com if access restrictions prevent you from using the deletion feature. Any information retained after access ends remains subject to the Privacy Policy and applicable legal obligations.
